That, they argue, could allow users to inhale more deeply and absorb more nicotine.<\/p>\n\n\n\n<p>On that basis alone \u2014 even where direct evidence is missing \u2014 the ministry is invoking the \u201cprecautionary principle\u201d to justify an outright ban.<\/p>\n\n\n\n<p>Critics will note that menthol has been used for decades in medicines and consumer products, including inhalers for colds. The draft itself admits that firm evidence of increased nicotine uptake from menthol vapes is lacking. Nonetheless, officials say the \u201cperceived cooling benefit\u201d is enough to warrant prohibition.<\/p>\n\n\n\n<p>The ban would apply to both e-cigarettes and refill containers, forcing manufacturers to reformulate products or withdraw them from the German market altogether. The ministry estimates a one-off compliance cost of just \u20ac46,000 across the entire industry \u2014 a figure likely to be disputed.<\/p>\n\n\n\n<p>The regulation also tightens administrative rules, including stricter language requirements on packaging and new powers for authorities to demand product samples during approval procedures.<\/p>\n\n\n\n<p>If adopted, the rules would enter into force six months after publication.<\/p>\n\n\n\n<p>Germany\u2019s move adds pressure on other EU countries already debating whether \u201csensory effects\u201d \u2014 not just flavours \u2014 should be enough to justify bans.
